Tupperware recognizes that our sales force members use many different avenues to sell our products. We have received many inquiries asking if eBay is an approved avenue for selling Tupperware® products. The following Q & A will help clarify the Company’s policy on using eBay as a selling tool.

Tupperware’s Policy Regarding eBay

Tupperware recognizes that our sales force members use many different avenues to sell our
products. The Internet has provided many new and creative ways to expand the Opportunity and
product offerings to more customers. The popular auction site eBay is one such avenue. We have
received many inquiries asking if eBay is an approved avenue for selling Tupperware® products.
The following Q & A will help clarify the Company’s policy on using eBay as a selling tool.
But first, keep in mind the most profitable and valuable selling method you have as a sales force
member is the Party. We recommend you begin by creating value-added relationships with your
Hosts and party guests, Showcase leads, and My.Tupperware Internet buyers, which are the tried
and true building blocks of a successful Tupperware business

Q 1: Can members of the sales force sell current products on eBay?
A: No, eBay is not an approved selling method for Tupperware sales force members. Selling our
products in an auction setting only degrades our brand and undermines the value of the
Tupperware Opportunity. Selling products that are in our current line on eBay is a violation of the
Tupperware Consultant Agreement, and can result in the immediate termination of your authority
to act as an authorized Tupperware Consultant.

Q 2: Can sales force members advertise and/or sell the business kits on eBay?
A: Business kits may be listed on eBay as a way to advertise the Opportunity, ONLY if the kit is
listed at the full retail price determined by Tupperware. Efforts to conceal a lower business kit
price with an inflated shipping and handling charge are not permitted. The information presented
with the business kit may not misrepresent the Tupperware Opportunity in any way. Failure to
adhere to these guidelines can result in an immediate termination of the Consultant’s authority to
act as an authorized Tupperware Consultant.

Q 3: Can sales force members sell any product on eBay?
A: One of eBay’s basic policies for selling anything on their site is that you must own and have
physical possession of any product before you can sell it on eBay. If anyone sells products on
eBay before having physical possession and ownership of the item and/or fulfills the customer
order from some other form of order fulfillment system (such as the My Sales Web Application)
the sellers’ rights on eBay will be revoked. Equally, any Tupperware Consultant who sells
products from our current product line on eBay and fulfills the order from the My Sales Web
Application will have their rights as a Tupperware Consultant immediately revoked.

Q 4: There are so many listings of product on eBay. Can they be removed?
A: When a person has full ownership and possession of a product, that person legally has a right
to do whatever she/he wants with the product. Customers who have products they no longer want
may desire to sell the products, much like a garage sale. Therefore, Tupperware is not able to
remove many of the listings on eBay, unless the listings are created by sales force members who
are fulfilling the orders through the My Sales Web Application.

Q 5: Does this mean that sales force members can sell products they own and possess?
A: Technically yes. However, we strongly recommend that you avoid this practice. Although
selling products on eBay may appear to be a good way to reduce or eliminate an inventory of
extra product, selling a premium brand such as Tupperware® products on eBay diminishes the
value of our brand. It also eliminates the opportunity to create a lasting relationship between the
sales force member and the customer; raises potential warranty issues; and does not accurately
represent the Tupperware Opportunity. Again, any Tupperware Consultant who sells products
from our current product line on eBay and fulfills the order from the My Sales Web Application will
have their rights as a Tupperware Consultant immediately revoked.

just a heads up on something I recently learned using ebay - no seller can use a photo with a copyright in their ebay listing. If you come across someone you suspect is a consultant and is selling product by "cut and pasting" a photo of the product from the Tupperware website, then you can report the seller to ebay. Thought I share, I got some fake name brand Jewerly (Tiffany & Co.) a few weeks ago and reported it to ebay and since the seller had done the "cut & paste" that I mentioned, ebay removed the listing.

You can also report Ebay violations and Tupperware domain name, advertising and other tupperware violations to Tupperwares Legal Dept....I often email their legal dept violations I see.

Consultants dont realize that they cant use the tupper, tupperware, tupp etc in their domain names or backdoor sly domain names.
